These Terms of Service constitute a legally binding agreement between you (the "Client" or "User") and IT Atmoz Information Technology Private Limited (the "Company"). By engaging with our services, you acknowledge that you have read, understood, and agree to be bound by these terms.
Acceptance of Terms
By accessing or using any service provided by IT Atmoz Information Technology Private Limited, you agree to be legally bound by these Terms of Service. If you do not accept these terms in their entirety, please discontinue use of our platforms, products, or services immediately.
Scope of Services
IT Atmoz provides enterprise-grade digital solutions including:
- Custom web and mobile application development
- SaaS platforms and enterprise software systems
- AI-powered tools and automation solutions
- Cloud infrastructure setup (AWS, Azure, GCP)
- UI/UX design and digital consulting
- API development and system integrations
Note: Services may be modified, expanded, or discontinued based on business requirements without prior notice.
User Responsibilities
As a user of our services, you agree to:
- Provide accurate and complete information during all communications
- Use our services exclusively for legal, ethical, and authorized purposes
- Maintain strict confidentiality of login credentials, API keys, and access tokens
- Not engage in reverse engineering, copying, or unauthorized distribution of our code
- Comply with all applicable local, state, national, and international laws
Intellectual Property Rights
All content, source code, designs, documentation, and proprietary systems developed by IT Atmoz are protected intellectual property under Indian copyright law. Unless explicitly stated in a signed contract, you may not:
- Copy, modify, or distribute our code or designs
- Resell or sublicense our products or services
- Reverse engineer or decompile our software
- Use our brand name, logo, or trademarks without written permission
Note: Client-specific work is transferred to clients only after full payment and completion of all contractual obligations.
Payment & Refund Policy
All invoices are due according to agreed project milestones and timelines. Payment terms are defined in individual contracts or proposals. We operate under the following financial policies:
- No refunds for completed development, design, or consulting services
- Partial refunds may be considered only for uncompleted work, at our sole discretion
- Payment delays may result in service suspension or project termination
- Late payment fees may apply as per the signed agreement
Note: Exceptions may be granted only if explicitly documented in a signed contract or official email communication.
Limitation of Liability
IT Atmoz shall not be held liable for:
- Indirect, incidental, or consequential damages arising from service use
- Data loss due to third-party service failures (hosting providers, cloud platforms)
- Business losses, revenue loss, or opportunity costs
- Damages resulting from unauthorized access or security breaches not caused by our negligence
Note: In any case, our maximum liability shall not exceed the total amount paid for the specific service in question.
Service Termination
We reserve the right to terminate or suspend access to our services under the following conditions:
- Violation of these Terms of Service
- Non-payment or breach of contract
- Fraudulent activity or misuse of our platforms
- Operational, legal, or business reasons
Note: Clients may request service closure or account deletion by contacting us via official email. Data retention policies will apply as per our Privacy Policy.
Governing Law & Jurisdiction
These Terms of Service are governed by and construed in accordance with the laws of the Republic of India. Any disputes, claims, or legal proceedings arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts located in Chennai, Tamil Nadu, India.
